Carter Ruck judgment

Jayne Willetts welcomed the judgment of Mr Justice Butcher in Carter Ruck Solicitors & Another v SRA [2026] EWHC 2146 (KB) ruling that the SRA did not have the power to order law firms to disclose legally privileged material without their clients’ consent and congratulated Carter Ruck and their client for bringing the case. Jayne has been challenging the SRA for many years on the extent of its powers during investigation so the judgment makes for very interesting reading – the SRA is appealing the decision – so watch this space.
